Policies and Legal Disclaimers

General Disclaimer: Martin Process Serving, LLC (“we,” “our,” or “us”) provides professional process serving, skip tracing, surveillance/stakeout, mobile notary services, court filings/document retrieval, and property/occupancy checks throughout Iowa. We are not attorneys and do not provide legal advice. Any legal questions should be directed to a licensed attorney. Our role is limited to delivering, locating, observing, or notarizing documents and persons in accordance with applicable laws and regulations.

Process Serving Policy: We make reasonable and timely attempts to serve documents in accordance with Iowa Rules of Civil Procedure and applicable court orders. We are not responsible for incorrect or incomplete information provided by the client. We reserve the right to refuse service if a situation presents a safety risk to our personnel. Service fees are non-refundable once attempts have been made, regardless of the outcome. A notarized Affidavit of Service will be provided upon completion.

Skip Tracing Policy: All skip tracing is conducted in compliance with the Gramm-Leach-Bliley Act (GLBA), Driver’s Privacy Protection Act (DPPA), and other applicable state and federal laws. Information obtained through skip tracing is for legitimate legal purposes only, such as service of process, debt recovery, or court-ordered investigations. We do not sell or provide skip trace data for marketing, harassment, or unlawful purposes. Clients are responsible for ensuring they have a lawful purpose for requesting skip tracing services.

Stakeouts/Surveillance Policy: All surveillance is conducted in public spaces or other locations where there is no reasonable expectation of privacy under Iowa or federal law. We do not trespass, break and enter, or otherwise violate any laws to conduct surveillance. Photographs, videos, and written reports are for client and court use only and may not be publicly distributed without permission. Surveillance activities may be terminated immediately if safety concerns arise.

Mobile Notary Policy: Notarizations are performed in accordance with Iowa Code Chapter 9B. A valid, government-issued photo ID is required from each signer. We will not notarize documents that are incomplete, blank, or where the signer appears unwilling, coerced, or unable to understand the document. Fees are in accordance with Iowa law plus reasonable travel charges.

Court Filings/Document Retrieval Policy: We provide court filing and document retrieval services in accordance with applicable Iowa court rules and procedures. Clients are responsible for providing accurate and complete information, including case numbers, party names, and filing instructions. We are not responsible for delays caused by incomplete, incorrect, or outdated information provided by the client, or delays resulting from court closures or clerk’s office procedures. Fees are non-refundable once an attempt to file or retrieve documents has been made. Copies of retrieved documents will be delivered electronically or in the format requested, subject to court availability and applicable fees.

Property/Occupancy Checks Policy: All property and occupancy checks are conducted lawfully and from public vantage points only. We do not trespass, enter structures, or engage in activities that would violate state or federal law. Observations may include, but are not limited to, exterior condition of the property, visible signs of occupancy, vehicles present, and general upkeep. Photographs, video, and written notes are for client use only and will not be distributed publicly without authorization. Clients must have a legitimate and lawful purpose for requesting these checks. Services may be terminated immediately if safety concerns or unlawful requests arise.

Defensive Tools/Field Work Policy: Martin Process Serving, LLC is a private business and not a law enforcement agency. Our personnel are not police officers, deputies, or government agents, and we do not represent ourselves as such. All services are provided strictly as private process servers, notaries, or support professionals in accordance with Iowa law. For personal safety during field operations, our personnel may lawfully carry defensive tools such as body-worn cameras, pepper spray, flashlights, or expandable batons. These items are carried solely for defensive purposes and never used to intimidate, coerce, or impersonate law enforcement officers. All tools are carried in compliance with Iowa law and are intended only for self-protection in the event of an immediate threat. We do not use sirens, police-style insignia, or any equipment restricted to law enforcement agencies. Any use of defensive tools is reactive and limited to protecting the safety of our personnel. If any defensive tool is ever deployed in the field, local law enforcement will be contacted immediately, and a full incident report will be documented.

Privacy Policy: We collect only the information necessary to perform the requested service. All client and case information is kept confidential and will only be shared as required by law or court order. All body-worn camera footage, photos, and notes are retained for a minimum of 90 days unless required longer for legal purposes.

Liability Limitation and Insurance: While Martin Process Serving, LLC makes every effort to perform services accurately and safely, delays or issues outside our control (e.g., incorrect addresses, dangerous conditions, inability to locate subject) are not our responsibility. Our liability is limited to the coverage provided under our active insurance policy or, if not applicable, to the amount paid for the specific service. Proof of insurance is available upon request.
